OSVDPA Antitrust Policy Statement

The Offshore Service Vessel Dynamic Positioning Authority (OSVDPA) endeavors to be an important asset to the dynamic positioning operator (DPO) community by improving the DPO certification process. To fulfill this legitimate purpose, the OSVDPA, its members, and those who affiliate themselves with the OSVDPA via certification, accreditation, or approval, must be able to freely exchange ideas and discuss issues of legitimate concern to the industry. Concurrently, the antitrust laws strictly limit the types of agreements competitors may have with each other.

OSVDPA members, employees, affiliates, and contractors, therefore, must be cognizant of their obligation to comply with the antitrust laws whenever attending a meeting of the Authority, or participating in the business of the Authority, and must be sensitive to how their remarks might be interpreted by others to even any appearance of impropriety.

Significantly, under the antitrust laws, there are some subjects which are not proper for discussion at any time because they may result in an antitrust problem even when no one intended to do anything wrong. Therefore, the OSVDPA prohibits its members, employees, affiliates, and contractors from engaging in any discussion of price, rates, fees, terms, profit margins, credit terms and other terms of business transactions or sales. Additionally, the OSVDPA, its members, employees, affiliates, and contractors shall not discuss any action which withholds patronage or services from any supplier or customer, any actual or potential competitor, or any government entity.
